Before heading back up to the deck to soak up the salty air, you may want to grab our Signature Cocktail, The Dark & Stormy (Captain Steve’s favorite) and literally drink in all of the views up above. Whether you are joining us for a Team-Building Event through your company or a Wedding, Birthday or just a day of Sailing, one thing is for certain, you will love every second of it. Our experienced Team of Sailors will hoist our massive sails as we glide past such iconic landmarks as Alcatraz - up close and personal, to the Golden Gate Bridge, Angel Island, views of Marin and Mt. Tam and of course, the majestic skyline of San Francisco with The Ferry Building, Coit Tower and Pier 39 to name a few. TERMS AND CONDITIONS- here is the fine print Included and Excluded from the Charter Fee: The charter fee includes the services of a Captain and Crew, fuel, and all expenses related to running the Yacht and use of on-board equipment. The charter fee does not include:meals, alcoholic beverages, (optional), crew gratuities, off - Yacht excursions, any dockage charges, cruising taxes and permits, sales taxes, and any port fees. Cancellation: 100% refund if canceled 30 days before the charter50% refund if canceled between 30 days and 7 days before charterNo refund if canceled less than a week before the charter, you are always welcome to apply money paid to a new charter date at no additional cost. 100% refund if we cancel the charter for weather, boat or safety or any other reason Cancellation: If the charter is canceled by Bay Lights Charters, or because of COVID-19 then Bay Lights Charters shall reimburse the Charterer for all fees paid as of the date of cancellation. Liability Waiver: Bay Lights Charters shall not be held responsible for loss or damage to personal property or for any injury suffered by the Charterer, or any member of his party, during the term of this charter, regardless of whether any such loss or injury occurs onboard the Yacht or elsewhere, unless such loss, damage or injury is the direct and proximate result of Bay Lights Charters sole negligence. More specifically, but without limiting the foregoing, Bay Lights Charters and their insurance underwriters accept no responsibility or liability for accidents, injury, or death related to the Yacht. Furthermore, the Charterer shall reimburse Bay Lights Charters for any property or equipment lost or damaged due to the actions of the Charterer and his party during the charter. All guests will sign a waiver prior to boarding the vessel. Delay, Breakdown, Accident: In the event of a delay, breakdown, or accident, Bay Lights Charters will attempt to remedy the problem within 24 hours. In the event the remedy is not timely completed, then the charter may be terminated at that point by either Bay Lights Charters or Charterer, with the charter fee to be refunded based upon the proportion of the charter uncompleted. The parties agree that the Charterer will be responsible for the onward transportation of any persons aboard from the point of termination of the charter. Force Majeure: Force Majeure is defined as any cause attributed to Acts of God, accidents, natural disaster, weather, or other occurrences beyond the reasonable control of Bay Lights Charters, and not caused by their negligence. No warranty is made as to the suitability of weather with respect to this charter. Weather and sea conditions are valid reasons for the termination of a charter. The Charterer recognizes that the charter voyage may not be able to proceed where and when originally agreed due to weather / and or sea conditions. Thus, if a storm threatens or high winds and potentially dangerous sea conditions are forecast to threaten the expected location of the charter Yacht, as determined by the Captain at his sole discretion, the Captain shall have the option of terminating or canceling the charter any time he deems necessary. No refund will be provided for cancellation due to potentially high winds, dangerous weather, or adverse sea conditions. However, the Charterer may reschedule the charter for another time and place agreed upon by Bay Lights Charters and receive a credit of the full amount previously paid. Indemnify, Defend, Hold Harmless: The Charterer agrees to indemnify, defend and hold harmless Bay Lights Charters from any and all claims and liabilities for loss or damage to himself, crew, guests, and to any third parties whatsoever, which may be occasioned by the fault, including ordinary negligence, of Bay Lights Charters or the Charterer and his guests or third parties. Food Cleaning Fee: In the event that the Charterer chooses to bring and serve food (other than small snacks) onboard the Yacht, Bay Lights Charters will be entitled to charge an additional cleaning fee to be determined by Bay Lights Charters depending upon the number of guests and type of food to be served during the charter. Responsibility for Children and Health of the Charterer: If children are taken on board the Yacht, the Charterer shall be fully responsible for their conduct and entertainment and no member of the crew shall be held responsible for their conduct or entertainment. The nature of a charter may render it unsuitable for anybody with a physical disability or undergoing medical treatment. Within this Agreement, the Charterer warrants the medical fitness of all guests and participants of the Charterer’s Party for the voyage contemplated by this Agreement. Safety of the Yacht: Bay Lights Charters may terminate the event, without refund, or remove one or more persons from the Yacht, for actions of the Charterer or a member of his party which jeopardize the safety of the Yacht or persons aboard, at the sole discretion of Bay Lights Charters or the Captain. Captain and Crew: Bay Lights Charters shall provide a Captain qualified in accordance with the Yacht’s flag State requirements and the U.S. Coast Guard acceptable to the insurers of the Yacht. Bay Lights Charters shall also provide a suitably qualified and properly trained Crew. No member of the Crew shall carry or use any illegal drugs on board the yacht or keep any firearms on board the Yacht. Captain’s Authority: Bay Lights Charters warrants that the Captain meets all requirements necessary to legally command the Yacht in the area in which the Yacht is chartered. While it is agreed the Charterer may determine the general movements and destination of the Yacht within the boundaries of this Agreement, it is understood that the Captain is in full command and that the Charterer, and all of the passengers/guests of the Charterer, agree to abide by the Captain’s judgment as to clearance, sailing, course, speed, destinations, weather and or sea conditions, anchorages, vessel traffic and other pertinent matters regarding the safety of the vessel and all persons on board. Restricted Use: The Charterer agrees that the Yacht shall be employed exclusively as a pleasure vessel for the sole and proper use by the Charterer itself, and guests and servants of Charterer, during the term of this charter, and shall not transport the merchandise, or engage in any trade, nor in any way violate the Laws of any Government, whether it be Federal, State or local law, within the jurisdiction of which the Yacht may be at any time, and shall comply with the law in all other respects. If the Charterer or any of the guests of the Charterer shall commit any offense contrary to the laws and regulations of the USA or California which results in any member of the Crew or Captain of the Yacht being detained, fined or imprisoned, or the Yacht or owners of Bay Lights Charters being detained, arrested, seized or fined, the Charterer shall indemnify all parties against all loss, damage, and expense incurred by Bay Lights Charters as a result, and Bay Lights Charters may, by verbal or written notice to the Charterer, terminate this Agreement forthwith. Drugs, Weapons, or Other Illegal Activities: The use, transportation, or possession of illegal drugs or narcotics (INCLUDING MARIJUANA), or of weapons, or of any other contraband, or the participation in any other unlawful activity is strictly prohibited. The possession of or participation in any of these activities by Charterer, or by any guest of the Charterer, constitutes a breach of the Agreement and shall be cause for immediate termination of this Agreement without refund of any payments made by Charterer. The charterer will be held responsible for any loss or damage to the Yacht due to any such violations and will be put ashore at the next or closest port of call, at the Captain’s sole discretion. Venue and Choice of Law: The venue of any lawsuit arising from this Agreement shall lie exclusively in the Courts of the City and County of where the vessel is operating, whether it be Federal Court or State Court, and both parties shall submit to the jurisdiction of such court. The applicable law for any action arising from this Agreement shall be Federal Maritime Law and California law.Execution of Agreement: Bay Lights Charters and the Charterer, whose signatures need not be affixed to the same copy of this YACHT CHARTER AGREEMENT, may transmit the Agreement by facsimile, email, or other electronic means. The separately signed Agreement, and/or copies thereof, shall constitute a binding Agreement between Bay Lights Charters and the Charterer.
